Ultrashock, LLC (“us”, “we”, “our” or “Ultrashock”) recognizes that our registered users have legitimate concerns about privacy with respect to our Web site (“site”). Your privacy is a top priority. Please read the following terms of our Privacy Policy.



General

Our site allows you to buy products, participate in forum discussions, contents and sweepstakes, fill-in surveys, and receive newsletters, e-mails or other promotional information from us. We use the information that we collect about you to provide you with the highest possible level of security and service, process your product orders quickly and accurately, and make your on-line experience convenient and efficient. This is just a brief overview, so please read on for more details about our Privacy Policy. This Privacy Policy may change from time to time, so please check back periodically. Except as otherwise limited by this Privacy Policy, we reserve the right to use and disclose your personally identifiable information for purposes relating to the administration and operations of our site and Ultrashock.

This document only addresses the use and disclosure of information we collect from you online or via communications with you. For some services, we collect and transfer personal information to third-parties you have selected or you may visit third-party Web sites through links on our site that may collect and use your personal information. In those cases, their privacy policy will govern how your information is handled. You should very cautious before you disclose your personal information to anyone.



Information We collect from you

We collect two types of information about visitors to our site: Personally Identifiable Information (or “PII”) and Non-Personally Identifiable Information (or “Non-PII”). Our primary goal in collecting information from you is to provide you with a smooth and efficient experience while using our site.

  1. Personally Identifiable Information. This is information that tells us specifics of who you are. PII is requested when you register and set up an account, join a forum, order a product or service, register as a content supplier, and send us feedback. For example, this information might include your name, billing address, e-mail address, credit card or other payment information, product details, username and password. We use this information for you to register and for us to fill your orders and better provide you with personalized services. If you visit a third-party’s Web site through a link on our site, please read their privacy policy and ask them questions about their information practices, because we do not control how they handle any PII that you disclose to them.
  2. Non-Personally Identifiable Information. This refers to information that does not, by itself, identify you or another specific individual. For example, this information may include the Web address of the site that you just came from, which Web address you go to next, what browser and operating system you are using, and Internet Protocol (“IP”) address that identifies your computer.
    On an aggregated basis, we collect and use for internal purposes anonymous data related to the pages, products, downloads and other content that is sampled, clicked on, searched for, transferred from and downloaded.



How we gather information

  1. Registering. When you register with us, we collect personally identifiable information from you. For example, to register and participate in our forums, we will collect and maintain your name, email address and password as part of the registration/sign-up process. In addition, and at your option, you may provide us with your date of birth, a short biography, occupation and the home page of your website, if any. Any or all of this additional, optional information may be displayed as part of your user profile accessible to other registered users.
  2. Purchasing Credits & Ordering. When you wish to purchase credits and/or use them to order a download or a product from us, we collect PII from you. We collect and maintain such personally identifiable information as your name, e-mail address, billing address, shipping address, product selections, credit card or other payment information, order number, the Uniform Resource Locator (“URL”) of the referring Web site, IP address, and a password; and to set up a company account, we also collect and maintain your company’s name, tax identification number, telephone number and facsimile number, as well as your title at the company. We collect this, and other information, as disclosed in this Privacy Policy to deliver the download or product, to pay royalties and license fees, to communicate with you about your order, and administer our site and to send you promotional materials.
  3. Light Box. Through the use of a “Light Box” we offer you the ability to store search results, and other information collected from our site. You can return to the Light Box you create from time-to-time as part of your on-line experience. You can use a Light Box to organize Products and information on a project-by-project basis and to make use of a site e-mail tool to communicate with others, including registered and unregistered users to view and comments on the contents of your Light Box. You can create multiple Light Boxes, one for each project, and make them public or private to suit your needs. Only registered users may create Light Box. Anyone can view them once invited-in. If you decide to set-up a Light Box, we will collect and use the recipient’s e-mail address (and any other information he or she chooses to disclose). In addition, your name and email address (and any other information you choose to disclose) may be accessible to others given access to your Light Box.
  4. Newsletters, Promotional and Personal E-mails. We offer free newsletters, promotional e-mails, and e-mails from other registered users, as a service to our registered users. We will send you newsletters, as well as e-mails periodically listing current offerings and special deals. Other registered users may e-mail you about these and other matters of interest to them. However, you may "opt-out" or unsubscribe from our newsletters and emails by following any unsubscribe instructions in any newsletter or e-mail you receive from us, or by declining to receive newsletters and e-mails from us and/or others when you register with us. After doing so, you will not receive any newsletters or promotional emails in the future (or at any time if you “opt out” during registration), unless you open a new account or otherwise subsequently sign up to receive them.
  5. Customer Service. If you contact us by telephone, e-mail or letter, we may keep a record of your correspondence or comments. If you report a problem with our site, we may collect such information in a file specific to you. If you contact us through our feedback area or by calling one of our customer service representatives, we may ask for your name and username, e-mail address and order information to send you a reply. If other users send us correspondence about your activities on our site, we may keep the information in a file specific to you.
  6. Web Site Use. We track users’ traffic patterns throughout their online session, including which pages, information and advertisements they view while using the site and what products they store in their Light Box or place in their shopping cart or purchase. We use your IP address to diagnose problems with our servers, software, to administer our site and to gather demographic information. We also collect information from visitors to our site regarding the Web sites they came from, domain names (e.g., .com or .org), their IP addresses, the date and time of their visit, the number of visits, the number of visits per browsing session, the server type, the operating system and browser type used to visit the site, the country and state where their servers are located, the pages and page titles of our site they view during their visit, whether the visitor's computer is enabled for Java or cookies, browser language, applications and plug-ins, and any search terms entered on our site.
  7. Cookies. We use data collection devices such as "cookies" (small text files that are placed on your computer's hard drive for record-keeping purposes) to assist us in the operation of our site. Cookies make using the site easier by, among other things, saving your passwords and preferences for you, helping identify you whenever you return to our site, and reducing the number of times you are required to enter your password during a session. Most Internet browsers are initially set up to accept cookies. However, you can reset your browser to refuse all cookies or to alert you when a cookie is being sent (note: you may need to consult your browser's "Help" area for instructions on how to do that). If you choose to disable your cookies setting or refuse to accept a cookie, you may not be able to use certain features on the site and you may be required to reenter your password more frequently during a session.
  8. Site Searches. Registered and others users may visit and search our site for Product offerings and other information available for public viewing. We may collect and use PII if a registered user is logged-in and conducts a search, including his or her name, username, e-mail address and search terms. For all others, we may collect and use Non-PII similar to the information we collect from visitors generally in connection with Web Site Use, as described above.



Information collected by third parties

  1. Links and Banner Ads to Third-Party Sites. Please be aware that our site may contain links to other sites on the Web that are owned and operated by third parties, including but not limited to, third-party service providers and merchants. The information practices of the Web sites linking from or to our site are not covered by this Privacy Policy. Such other sites may send their own cookies to users, collect data, or solicit personal information. Additionally, other companies which place advertising on our site may collect information about you through the use of cookies when you view or click on their advertising. We cannot control this collection of information. You should contact advertisers directly if you have any questions about their use of the information that they collect.
  2. Other Registered Users. Please be aware that your use of our site may result your disclosure of your personal information to others. For example, you may post information in our forums, send private messages to specified users, e-mail others, and disclose and permit others to view information you voluntarily make public. You do so at your own risk. Ultrashock strongly recommends that you do not share your personal information, including but not limited to your username and password, to anyone else.



Who we share your information with

  1. Order Fulfillment. The information we collect is used for processing orders, keeping you informed about your order status, for statistical purposes, for improving our site and its performance, and to notify you of products or special offers that may be of interest to you. We will disclose your PII to third parties to charge your credit card and to deliver products other than downloads. For example, we must release your credit card information to PayPal, the card-issuing bank and card processor to confirm payment. If you request a shipment, we will disclose your name and shipping information to third parties as necessary for product delivery.
  2. Other Persons Generally. We may provide Non-PII about our users' sales, traffic patterns, and related site information to third parties, but these statistics do not include any PII. We may release account information when we believe that such release is reasonably necessary to enforce or apply our Terms of Use or to protect the rights, property, and safety of Ultrashock, our users, or others as we deem necessary (in our sole discretion). If customers do not pay us for products ordered, we may submit their account information to a third party collection agency. We may also share your Personally Identifiable Information with third parties who provide services to us, our customers and web site visitors. Those third parties include authorized contractors and consultants who assist us with site development and business operations (collectively, "agents"). Where we believe it to be appropriate in our sole discretion, we will ask our agents not to disclose or use your personal information for purposes other than to provide services to you or Ultrashock.
  3. Compliance with Service of Process or Law Enforcement. We will disclose PII upon receipt of a court order, subpoena, or to cooperate with a law enforcement investigation, without prior notice to you, to the extent we deemed necessary to comply with applicable law. We reserve the right to report to law enforcement agencies any activities that we believe to be unlawful.
  4. Sale of the Company. We reserve the right to disclose your Personally Identifiable Information in the event that we are sold, in whole or in part, either as an entire entity or through an asset sale, merger, or other method that includes a customer information database. This right is reserved whether or not the customer database is sold independently of any continuing operations of such company.
  5. Content Providers. In addition to other disclosures as set forth in this Privacy Policy, we may make our customer records available to the licensor's of our digital content available for purchase on our site, and to their outside auditing agents on a confidential basis as part of periodic audits of our product sales.



How to update or correct your Personally Identifiable Information


We believe you should have the ability to access and edit the personal information that you have provided to us. During the online ordering process you can review, change, or delete the information that you have submitted. You may change any of your personal information in your account online at any time by clicking here, or by submitting a ticket at http://support.ultrashock.com/account. We encourage you to promptly update your information if it changes. You may ask to have the information on your account deleted or removed; however, because we keep track of past purchases and site operations, you cannot delete information associated with past purchases or previous activities on our site. Also, as a security measure we "back up" the data stored on our systems, and such prior information cannot be completely removed from our databases. As a result, you should not expect that all of your PII will be completely removed from our backed-up databases.



Security precautions in place to protect against the loss, misuse, or alteration of your information


To most efficiently serve you, credit card transactions and order fulfillment are handled by established third party banking and processing agents. They receive the information needed to verify and authorize your credit card or other payment information and to process your order. They are responsible for the implementation and supervision of their security systems and safeguards.
Within Ultrashock, your information is kept on password protected, limited access servers. Wherever possible and applicable, our servers reside behind a firewall that maintains controls on access to the system from the Internet. All passwords and orders are processed on our site using 256 bit encryption technology, or if less, the highest bit rate encryption your browser can handle.
